No indictment for store owner who fatally shot robbery suspect

HAMILTON, OH (FOX19)- No charges will be filed against a store owner who shot a robbery suspect in Hamilton.

A Butler County grand jury considered the case involving Smail Gueddari and returned no indictment.

Gueddari shot and killed Jeremy Scott Irwin, 26, during an aggravated robbery at Mazagan Urban Ware on Main Street on April 13.

According to a police report, Irwin entered the store, displayed a handgun and demanded money from the cash register.  Gueddari heard his wife screaming, came from the back of the store and shot Irwin.

Gueddari said he was trying to protect his wife and 2-year-old son, who was sleeping in a back room.
